  • Work Locations:
    • Location Limitations - Roadside service may be impractical or impossible if the road's shoulder is not wide enough to fully support work equipment. Additionally, busy roads may pose a safety hazard. Big & Heavy Equipment Service LLC reserves the right to restrict, limit, or refuse to perform work in areas Big & Heavy Equipment Service LLC feels may excessively limit mobility, create unacceptable risks, or cause safety concerns.
    • Extreme Conditions – In situations when work is performed in areas that are outdoors, unsheltered and exposed to the elements, Big & Heavy Equipment Service LLC may request to reschedule work.  If difficult or extreme conditions exist, such as heat, cold, strong/gusty winds, rain, snow, hail, etc. Big & Heavy Equipment Service LLC won't charge additional service call fees or fuel surcharges if weather forced the job to be rescheduled.
    • Biohazardous Equipment - Big & Heavy Equipment Service LLC reserves the right to refuse to touch the interior of any equipment that contains excessive amounts of trash, bad odors, insect infestations, etc. Please make sure the equipment is reasonably clean before Big & Heavy Equipment Service LLC personnel arrive or before delivering equipment for repair.
  • Unexceptable Behaviors:
    • Threats/Abuse to Personnel/Property - Big & Heavy Equipment Service LLC has a zero-tolerance policy regarding threats or physical or verbal abuse against Big & Heavy Equipment Service LLC personnel, associates or property. In such situations, Big & Heavy Equipment Service LLC personnel and associates will immediately terminate whatever work is in progress, leave the scene and will no longer perform any services for the customer. This also may extend to any friends, family, and/or associates of customers. Big & Heavy Equipment Service LLC will not return to complete any job that has been abandoned in-progress due to threats, and reserves the right to demand payment for the portion of the job that was completed.
    • Threats to Company - Big & Heavy Equipment Service LLC also has a zero-tolerance policy regarding threats against the company as a whole. Again, any threat of any type or nature, whether physical or otherwise, such as threatening to take unwarranted legal action or threatening to file unwarranted complaints with the State of Georgia and/or the BBB and/or Internet Reviews, will not be tolerated. Big & Heavy Equipment Service LLC’s response to threats against the company is the same as for threats made against Big & Heavy Equipment Service LLC personnel, associates or property - all work immediately ceases, and Big & Heavy Equipment Service LLC will no longer perform services of any kind for that customer. "Unwarranted" is defined as "the customer is upset with Big & Heavy Equipment Service LLC for: 1. Any action or inaction by Big & Heavy Equipment Service LLC in order to comply with legal laws and safety; 2. Any issue that is being handled under a supplier's warranty; 3. Any reason that is beyond Big & Heavy Equipment Service's control; 4. Any work declined due to equipment or location conditions; 5. Declining to provide unadvertised discounts.")
    • Drug/Alcohol Abuse - Big & Heavy Equipment Service LLC reserves the right to refuse to perform services for customers that are drunk and/or under the influence of drugs when Big & Heavy Equipment Service LLC arrives to render services. Work that is rescheduled for this reason will incur an additional service call fee, both of which will be due immediately upon Big & Heavy Equipment Service's second arrival.
  • Legal:
    • Permission for Repairs – By signing the work order, the client provides authorization for the repair work, materials, supplies, and parts required for repairs of the equipment. Repairs will not start until a work order is signed.
    • Liabilities - Big & Heavy Equipment Service LLC and/or their employees are not responsible for loss or damage to equipment or articles left in equipment in case of fire, theft or any other cause beyond their control or for any delays caused by unavailability of parts or delays in parts delivery by the suppliers or transporters. Big & Heavy Equipment Service LLC is not liable for any injury that may occur on the property of Big & Heavy Equipment Service LLC.
    • Permission To Operate – The client grants Big & Heavy Equipment Services LLC and/or their employees’ permission to operate the equipment on streets, highway or elsewhere for the purpose of testing and/or inspection.
    • Sharing Information – Client grants Big & Heavy Equipment Services LLC and/or their employees permission to share information with vendors necessary to quote prices and order parts needed for repairs of the equipment.
    • Releasing Equipment - Big & Heavy Equipment Services LLC will not release equipment to any other person or party except the owner, unless specifically told to do so in advance by the owner.
    • Beyond Control - Big & Heavy Equipment Services LLC is not responsible for things beyond Big & Heavy Equipment Services LLC control, which includes, but is by no means limited to, the following:
      • Acts of God, acts of nature, etc. (e.g., temporary closure brought on by a hurricane)
      • Incorrect/inaccurate information from a parts supplier (e.g., misquotes on pricing)
      • Mistakes on the part of a supplier (e.g., receiving the wrong part)
      • Shipping delays, especially during transit
      • Incorrect/inaccurate diagnostic and repair information provided to Big & Heavy Equipment Services LLC from reference sources (e.g., wrong labor times in labor guides)
    • Right Of Refusal - In accordance with Federal and State Law, Big & Heavy Equipment Services LLC reserves the right to refuse to perform repairs Big & Heavy Equipment Services LLC would consider inappropriate or unsuited to the problem at hand or that would in Big & Heavy Equipment Service's opinion render the equipment unsafe to drive.
    • Mechanic's Liens - Georgia law provides mechanisms for auto repair facilities to protect themselves against non-payment by customers. The principal mechanism is the "mechanic's lien," which, thanks to state reciprocity laws, will block the sale, transfer, and registration of equipment throughout most of the United States. All repairs are assumed to be protected by an implied mechanic's lien as well as all other mechanisms provided for under Federal and State Law.
    • If there is a Problem - If there's a problem, contact Big & Heavy Equipment Services LLC immediately. Most situations can be worked out to mutual satisfaction without any difficulty and with minimal to no expense. Please note that as standing policy Big & Heavy Equipment Services LLC automatically terminates all business relations with customers that threaten legal action when it's unnecessary and unwarranted, and Big & Heavy Equipment Services LLC automatically countersues on all small claims cases, so please consider the filing of a civil suit to be a last-resort option.
